Please review the following terms of use (the “user terms”) that govern your use of the Thistles website (“the website”). By using the website you agree to follow and be bound by the user terms. The user terms are intended to constitute the whole agreement. No information or advice given by any other means, such as on the website, by email or telephone call, will be binding.

REFUND POLICY
We hope you are pleased with your purchase from Thistles. Should you wish to return anything bought from Thistles, we will be happy to exchange or refund, provided it is in a fully re-saleable condition. Returns should be made within 28 days of purchase (a reasonable time). This does not affect your statutory rights.
Should you wish to return a sale item bought from Thistles, we will be happy to exchange or refund, provided it is in a fully re-saleable condition. Returns of sale items must be made within 14 days of purchase. This does not affect your statutory rights.
Please note that for international orders, returns must be received within 28 days of customer receipt of order.

RETURNS PROCEDURE
To make a return please send your item to the following address:
THISTLES, 23 Carradale, Orton Brimbles, Peterborough, Cambridgeshire, PE2 5XQ, United Kingdom.
Receipt of the item is deemed to be the date on which Royal Mail or other such carrier used, say that they delivered the item.
When making a return please include, your order number, the reason for the return and whether you would like a refund or replacement. Please securely re-package the item to minimise the risk of damage in the post. Proof of posting should be obtained when returning an item.
We will refund the price of the item to the purchaser or exchange the product once it is received by us. For a swift refund, please notify us of your intention to return an item by email at thistles@lovethistles.com.
Refunds can only be made via the original payment tender, including the original card of purchase.
Refunds to a card other than the original can only be processed under the following circumstances:
- The original account no longer exists
- The original account details have expired
- The recipient requires a credit
If you wish to return an item to which you no longer have the receipt we will offer an exchange or store credit to the sale price or current value of the item as applicable, provided it is in a fully re-saleable condition.
If we find that a product has not been returned to us in a fully re-saleable condition, we reserve the right to refuse refund or exchange of an item, or to deduct up to 25% off the original selling price from the refund amount.

DELIVERY CHARGES ON RETURNS
We will refund your original delivery charge when a product is incorrect, faulty or damaged, but not when a product is simply unwanted.

CANCELLATION OF ORDERS
A binding contract is formed once your order has been accepted. You may cancel your order within 7 days of your purchase but a small charge will be incurred due to PayPal transaction fees. Please note that we cannot cancel custom or rush orders either agreed verbally or in writing for a specific date for a customer.

We would hope that you are happy with Thistles and our products. AVAILABILITY
Prices and availability of items are subject to change without prior notice.
In the event that an item you want is OUT OF STOCK please feel free to contact us with details of the desired item and we will be happy to explore the options available to you. If we are unable to track the exact item we will endeavour to supply you with a comprehensive list of suitable alternatives for your perusal.

CONTRACTULISATION
No contract will be formed between you and Thistles Ltd for the sale of any items until payment is completed. Payment will be deemed complete on either a confirmation email from PayPal to both you and Thistles Ltd, or at such time as Thistles indicates via email that your cheque has been cleared by Thistles Ltd’s bank. Any email confirmation as detailed in this section, whether from Thistles Ltd or PayPal, will be deemed complete and, effectively, to have been communicated to you at the time the confirmation email is sent, regardless of whether or not the email is received.
Any contract can be cancelled by Thistles Ltd at any time at their sole discretion and all monies paid in respect thereof will be refunded.

CUSTOMS, DUTIES AND TAXES
All duties, taxes and any other payment whatsoever incurred in relation to the importation/exportation of goods from Thistles Ltd to another country will be payable by the purchaser of such goods.

LIABILITY
The use of this website is at your own risk. Thistles Ltd is not liable for any damage or loss whatsoever caused by the internet or our website or any related information technology. Thistles Ltd does not warrant that the website will be uninterrupted or free from computer viruses or other malicious programs or any other technical difficulties which may cause direct, indirect, consequential, incidental or any other damage to you or any other party.
Thistles Ltd shall not be liable to you or any other party for any loss or damage suffered whatsoever, including direct or indirect loss of profit, except from death or personal injury resulting from our negligence, due directly or indirectly to any use of this website or reliance on it or its contents or any information, advice or otherwise in any way connected with it.
Nothing on this website is warranted, either expressly or impliedly, and nothing therein shall constitute advice and should not be relied upon in any decision making. This website may include technical, typographical or other errors or omissions and Thistles Ltd will incur no liability arising from these. Thistles Ltd does not warrant the accuracy or reliability of any content, information, product or service provided by this website. Your statutory rights in relation to goods or services purchased through this website are not affected.

No liability whatsoever will be incurred by us in respect of any links contained in this website. We do not monitor or endorse any material accessed by means of links from our website and take no responsibility for the websites or material accessible via such links.

VARIATION
These Terms & Conditions may be changed by Thistles Ltd at any time at its sole discretion. Such changes will be intimated by the changes being posted on the website and you will therefore have been notified. The revised Terms & Conditions will take effect after a period of one week commencing from the time from which they are posted. By using the website thereafter, you will have accepted the varied terms and will be bound by them.

SEVERABILITY
In the event that any term of these Terms & Conditions is judicially held to be invalid or unenforceable, all of the remaining terms shall remain valid and enforceable.

INTELLECTUAL PROPERTY RIGHTS
Thistles Ltd owns all copyright and related intellectual property rights in and relating to the website unless otherwise agreed or specified. An individual page may be downloaded for private, non-commercial and personal use for the purpose of placing an order with Thistles Ltd or using this website as a shopping resource. With this exception, no contents of this website (including text, video, audio-visual material, graphics, underlying source code and software) may be copied, reproduced, distributed, republished, downloaded, displayed, posted or transmitted in any form or by any means without prior written consent. Such permission can be requested by emailing us at thistles@lovethistles.com.
All weights and measures are approximate. Images may be enhanced, enlarged or otherwise modified. Descriptions are compiled by reference to information available to us at the time of listing. Thistles Ltd shall incur no liability for inaccuracies in this respect but shall endeavour to refund or replace any item proven within 6 months of purchase by an independent registered specialist/laboratory report to be incorrectly described to a significant extent. Thistles Ltd shall be the sole judge of “significant” in this respect.

GOVERNING LAW
The use of this website and its Terms & Conditions and all contracts will be interpreted, construed and enforced in all respects in accordance with the laws of the UK, and all parties irrevocably agree to the jurisdiction of the British Courts.
